Avustaja päästetty vastaamaan vapaalta kotiarestista, joka kieltää mm. menemästä murhapaikkakunnalle ja pitämästä yhteyttä päätekijän kanssa. Syyttäjä vastusti vapaalta vastaamista koska katsoo avustajankin silti syyllistyneen murhaan, mutta tuomari katsoi että osallistuminen oli sen verran 'lievää' että saa vastata vapaalta. A teenage boy accused of murdering a woman at Callington has been released on home detention bail by the South Australian Supreme Court.
Pirjo Kemppainen, 63, was found stabbed and beaten to death at her home last September.
Two 14-year-old boys who cannot be publicly identified are charged with murder.
One has pleaded guilty and the second youth has pleaded not guilty and will stand trial.
The second youth now has been granted home detention bail by Justice Chris Kourakis.
Prosecutor John Wells opposed bail in any form, saying the prosecution case had only been strengthened since the previous occasions when the youth was denied bail.
Justice Kourakis called it a 'horrific murder'.
"The crime of which he is charged shocked the community because it was a horrific murder of an aged and very vulnerable member of the community," he said.
"The Crown case is that the accused entered into a joint enterprise with another youth, the express purpose of which was to murder Ms Kemppainen. The Crown case is that the accused's involvement in the murder was largely to accompany [the other youth] but that he also took some active steps as part of the plan to lure Ms Kemppainen from her home.
"It is the prosecution case that the accused is nonetheless guilty of murder by joint enterprise as his particular involvement does not lessen his culpability for murder."
Justice Kourakis said there were still grounds to allow bail.
"I take into account that the particular involvement alleged makes the risk of reoffending by the applicant less than it might otherwise have been if his participation in the murder had been more direct," he said.
"The presumption of innocence continues to apply and the presumption in favour of bail continues to apply.
"My task is not to determine the guilt or otherwise of the accused but whether the accused is at risk of further offending or of fleeing. I'm satisfied that with the strictest of home detention conditions that I propose the risk of both flight and further offending is sufficiently contained to allow the general presumption of bail to apply."
The boy, now 15, has been banned from entering Callington or communicating with his co-accused, who remains in custody.
The boy held his parents' hands and made no comment as he left the Supreme Court in Adelaide, accompanied by his lawyer.

A HATEFUL boy's need to empower himself drove him to kill Pirjo Kemppainen at Callington, a court has heard.
The Supreme Court was told yesterday the boy, now 15, was raised on a "constant diet" of violent entertainment by a father who encouraged retaliation, The Advertiser reported.
Forensic psychologist Dr Luke Broomhall said once the boy fixated on a "single-minded determination" to kill, he lacked the intellectual capacity to change his mind.
"His primary motivation is to become empowered, in any situation in which he feels disempowered, by any means necessary," he said.
"Unfortunately, 'any means necessary' includes taking down other people, innocent or guilty."
The boy has pleaded guilty to murdering Ms Kemppainen, 63, in September 2010. Details of the murder are suppressed because a co-accused will stand trial in March.
Ms Kemppainen's sister, Liisa Werchon, said in a victim impact statement yesterday she struggled to understand the boy's motive. "I feel deep anger toward (him) and wonder: What sort of person will he develop into if he can commit an evil act so early in his life?" she said.
Dr Broomhall said the boy's drive to kill arose from four factors:
COGNITIVE impairment that left him "mildly retarded", practically illiterate and with an IQ of between 60 and 71.
LIFELONG exposure to domestic violence.
TEASING, bullying and bashing at school that fostered hatred for others and a belief all strangers are enemies.
RELIANCE on his "constant diet" of violent movies and video games.
Dr Broomhall said on the day of the murder the boy was suspended for fighting at school.
"He experienced disempowerment and sanction in one situation and transferred his feelings on to an innocent third party," he said.
"(That) allowed him to express revenge and retribution."
John Wells, prosecuting, said the "savage" murder was "in the very highest category" of criminality.
Acting Chief Justice Margaret Nyland said sentencing the boy would be difficult; murderous youths are exempt from the mandatory 20-year minimum sentence.
She remanded him in custody for sentencing on a date to be set.

A PUBLIC servant has been charged with leaking confidential information about the murder of Pirjo Kemppainen.
Gavin Jeremy Wheeler, 47, of Underdale, will face Adelaide Magistrates Court next month.
He has yet to plead to four counts of divulging information obtained in the course of an administrative act.
Court documents allege that, while working at the Forensic Science Section, Wheeler leaked information on September 14, 2010 - three days after the retired nurse was killed.
They also accuse Wheeler of leaking other information on May 20, 2010, and on August 5 and August 15 that year.
The Advertiser understands prosecutors will allege the September incident relates to forensic evidence about Ms Kemppainen's killing, gathered by SA Police and the State Coroner's office.
They will allege he provided that information to his girlfriend in breach of Section 34 of the Coroners Act (2003).
If convicted, Wheeler faces a maximum fine of $40,000.
Court documents show defence counsel have indicated Wheeler will plead guilty to three of the charges.
Prosecutors are considering dropping the August 15 allegation, documents reveal.
Wheeler faces court again next month.
Two boys, both aged 15, have been charged with murder. One has pleaded guilty.
Prosecutors last week dubbed his crime a "frenzied and relentless attack, notable for its violence and savagery".
Acting Chief Justice Margaret Nyland said if the boy had been an adult, he "would be looking at a non-parole period over the 30-year mark".
The other boy will stand trial in March. Because of that, all details about the killing have been suppressed.
On the night she died, Ms Kemppainen called 131 444.
She reported a brick had been thrown through her window. No patrol was sent because no offenders were on site. One of her brothers found her body 16 hours later.
