Australian ryöstömurhaaja Pekka Hakala

Vuonna 1979 Pekka Ilmari Hakala (tuolloin 32-vuotias) tuomittiin rikoskumppaninsa Michale Saundersin kanssa Länsi-Australiassa Perthin kaupungissa tehdystä postiaseman ryöstöstä ja asemanhoitajan surmaamisesta - ryöstömurhasta - elinkautiseen vankeuteen.

Hän käytti ulkomaalaisena saamaansa tilaisuutta hyväkseen ja lusittuaan viisi vuotta anoi karkoitusta maasta eliniäkseen. Korkein oikeus hyväksyi anomuksen, johon kuului sopimus olla palaamatta ikinä Australiaan. Sinne hän oli muuttanut 50-luvun lopulla vanhempiensa kanssa.

Australian lakien mukaan Hakala oli rikoksensa sovittanut. Mutta... RL 1.luku 6. 7. & "jos Suomen kansalainen tekee rikoksen muualla kuin kotimaassaan hänet voidaan tarvittaessa tuomita rangaistukseen myös Suomessa. Ns. universaaliperiaate.

Pekka Hakala pääsi Seutulan (Hki-Vantaa) kentälle ja siellä oli KRP vastassa. "Sanoivat Sydneyssä, että olen vapaa mies lähtemään..." Ei auta, teidät asetetaan syytteeseen Australiassa 22.3.1979 tehdystä murhasta ja ryöstöstä".

Puolen vuoden oikeustaistelun jälkeen Pekka Hakala oli kuitenkin vapaa mies, mutta vailla paikkaa mihin mennä. Ystäviä ei ollut, sukulaiset olivat kääntäneet selkänsä ja vankilasta suoritettu kirjeenvaihto ei ollut tuonut toivottua elämänkumppania.

Hakala pääsi Toivolakotiin Hauholle. Kristilliseltä pohjalta toimiva paikka edellytti asukkailta ehdotonta raittiutta. Hakala kesti viikon ja korkkasi; murtautui asuntolan toimistoon ja huusi rappusilta lähtiessään, että "Nyt Hakalan poika lähtee Lontoon sumuun ja Sohoon!"

Ennen sitä Hakala meni kuitenkin vähäksi aikaa Pertti "Purtsi" Purhosen huomaan, ts. Helsingin Itäkeskuksessa olevan kriisipalvelun leipiin ja hommiin. Hän kävi hengellisissä kokouksissakin todistamassa uskonsa väkevyyttä ja kertomassa syntisen elämänsä vaiheista. Pian kuitenkin viinapiru kuiski ja vaati osuutensa. Kriisipalvelun ikkunat särkyivät ja omaisuutta katosi. Samoin kävi myös Naseem Ahmed -nimisen pizzerian ja squash-hallin. 14000 markkaa mukanaan Pekka Hakala suunnisti Lontooseen.

Lontoossa Hakala toimi omien sanojensa mukaan erään pankin turvamiehenä. Kaikki oli kait hyvin kunnes Helsingin hovioikeus katsoi Pekka Hakalan tarvitsevan vielä 10 vuoden istumisen Australian ryöstömurhasta.

Tuon jälkeen Hakalasta ei kuulunut vähään aikaan mitään, kunnes Alibin toimitus sai häneltä 17.12.1985 Amsterdamissa päivätyn joulukortin.

Kierreltyään aikansa Hollannissa ja Belgiassa Hakala päätyi takaisin Englantiin, jossa tapasi Australian aikaisen rikoskumppaninsa, joka kuitenkin oli saanut karkoituspäätöksen Englannista.

Vuoden 1987 syksyllä Pekka Hakala istui Hornbyn vankilassa Englannissa syytettynä raiskauksesta. Raiskaustuomio ei ollut suinkaan ensimmäinen. Australiassa Hakala oli syyllistynyt Maureen Griffiths - nimisen naisen raiskaukseen ja pahoinpitelyyn. Vuonna 1987 Hakala on istunut 40 ikävuodestaan jo puolet vankiloissa.

Mies olisi kuusikymppinen nyt, mikäli vielä porskuttaa. Näillä hiippareilla on kyllä tapana heittää vitoset hieman aiemmin.

Toki ovat suomalaisetkin "rikastuttaneet" maailmaa, etenkin aikanaan Ruotsia. Tätä lukuunottamatta kyllä sangen vähissä määrin kuitenkin.

HS:n kuukausiliitteessä lokakuussa 2008 oli sivuilla 76-81 toimittaja Jouni K. Kemppaisen artikkeli otsikolla "Vankina maailmalla". Pohjoismaiden ulkopuolella oli keväällä 2008 vankilassa 20 Suomen kansalaista. Heistä viisi vastasi kuukausliitteen kirjeeseen ja kertoi tarinansa.

Ainoa nimellään vastannut oli Pekka, nyttemmin siis Peter Hakala. Hän siis elää yhä ja suorittaa rangaistustaan Durhamissa Englannissa. Hakala kertoo syntyneensä vuonna 1947 Punkalaitumella ja muuttaneensa 13-vuotiaana vanhempiensa kanssa Australiaan. Siellä tapahtuneista lainvastaisuuksista jo osion aloituksessa kerrottiinkin.

Hakala sai elinkautisen vuonna 1986 kolmesta raiskauksesta ja lienee pisimpään vankilassa ulkomailla lusinut Suomen kansalainen. Omasta mielestään Hakala on syytön - todisteet olivat tekaistuja ja poliisit valehtelivat - ja haluaisi päästä Suomeen.

Hakala on nyt 61-vuotias. "Olen ollut lukittuna englantilaisiin vankiloihin yli kaksikymmentä vuotta enkä tiedä pääsenkö koskaan vapaaksi".

Hemmolla on siis jo toinen elinkautinen menossa.

Kahdestakymmenestä lähetetystä kirjeestä viisi meni Espanjaan. Sieltä vastasi 57-vuotias mies, joka suoritti tuomiotaan Malagassa pahoinpitelystä ja tapon yrityksestä. Neljä kirjettä meni Yhdysvaltoihin ja sieltä saatiin kaksi vastausta; 47- ja 60-vuotiaat miehet kertoivat tarinaansa. Niin ikään neljä kirjettä meni Viroon, josta tuli yksi vastaus Jay74 - nimimerkiltä. Ranskaan meni kaksi kirjettä ja yksi kirje lähti Kanadaan, Englantiin, Thaimaahan, Saksaan ja Australiaan.

Kirjailija ja taiteilija George Coombs ihmettelee Hakalan Englannissa saamia tuomiota.

Hakala kritisoi seuraavassa sitä, että hänen jo ulkomailla kärsimänsä rangaistukset ovat vaikuttaneet hänen saamiinsa tuomioihin Englannissa, ja ennen kaikkea, että hänen psyykkistä mielenterveyttä on epäilty.

DSPD: The name alone speaks volumes. it's dangerous, very dangerous, but I'll let you be the
- judge. Some years ago, I felt I needed a change in my sentence and agreed to go to Frankland DSPD Unit after I had received two invitation letters from two different people from their Multi-Disciplinary team who are not psychologists and who were telling me early in 2007 that my assessment would take place at Frankland DSPD Unit in August 2007.
On 20th July 2007 i arrived at Frankland and was seen by a trainee psychologist. After showing her the two invitation letters, the young psychologist fluttered her large eyes a few times and said to me, 'Peter, I have to inform you that your assessment will not happen before 12 months because we have a long waiting list.' My instant reply was if you have a long waiting list that is not my issue, I have in writing that my assessment should happen in August 2007.
A little time later I also found out that a psychologist had sent a letter to the Wakefield governor stating that my assessment would happen in 12 months, and pointing out that the Ministry of Justice wanted clarification on why I am a foreign national and so many years past my tariff and held in a DSPD Unit? Furthermore, the Ministry of Justice clearly pointed out that everyone in a DSPD Unit should have counselling and therapy days and weeks leading up to their assessment. The DSPD Unit psychologists totally ignored this and put themselves higher than the Ministry of justice.
Finally my assessment started not on August 12th, or even 12 month after arriving at the DSPD unit, but much much later. And, believe me, I did not like one moment of it. They started to do a risk assessment by using my overseas past historical factors and using PCL-R to make this risk assessment, which tome serves to be one way traffic, their way. Please note that I have served numerous sentences overseas — and not one psychologist or psychiatrist has ever made a risk assessment on me, so who or what gives the DSPD Unit psychologist authority to do a risk assessment on my past criminal activities and under which law are they carrying this out?
I am now on this OSPD Unit for interviews with psychologists for different reports but strongly disagree with the wording in their reports, which were always different to what took place during the interviews. I requested a copy of the interview and each time I got the same answer - `sorry - we don't have them. After using them to write your reports we destroy them.'
When I committed crime overseas and lived off the earnings of crime I was a criminal. I'll put my hands up to my overseas past, but because I am not in English prisons for my past, who gives the DSPD Unit psychologist the authority to paint me with this brush? I've been locked up in English prisons since 1986, and I have not once used any violence against another prisoner or staff. This should indicate tam not a psychopath like the DSPD Unit psychologist states. Ask yourself who are the psychologists working for? Certainly not for your best interests?
When the DSPD Unit opened it was for political reasons and nothing more. Another point worth noting is that not one person from Frankland DSPD Unit has been released on recommendation of their psychologist. We only have to listen to professional people like Professor Peter Tyrer's findings which clearly indicate nothing positive will ever come out of of the DSPD Programmes, especially those within prison.

Many thanks to all of you for your ongoing help and support from the bottom of my heart. My thanks also go to all my loyal supporters who have not let me down. I was wrongfully convicted over 24 years ago on fabricated evidence. Presently my legal team has contacted a linguistic expert to test three statements, one which I made and two which were fabricated. Now I am hoping that sooner rather than later all my supporters can be on my victory train celebrating justice day.

As a hostage in a foreign country, living in a dungeon, each day has its own difficulties. Some time ago HMP Wakefield stopped me receiving copies of newspapers. I took the matter to the prison and probation ombudsman and my complaint against the prison was upheld. Yesterday, I was informed by prison officers that I am no longer allowed to correspond with my long-standing supporter and friend Dr George Coombs because of some artwork I have on a website which I was told is making a profit. I have contacted the ombudsman and my solicitor about this. The prison authorities have not given me anything in writing, simply told me I can’t correspond with him because of the paintings. Please note my artwork is internationally known and I posted it all out from the prison using legal channels. There is no basis for what HMP Wakefield is saying. They are just harassing me because the ombudsman upheld my earlier complaint.

The prison is certainly in contravention of the Human Rights Convention article 10 – freedom of expression; article 8 – right to a private life; article 6 – right to prove your innocence. Dr Coombs, my solicitor and my barrister are working to defend my legal rights. No justice – no peace.

At the age of 14 my parents, sister and I left Finland destination Australia where we settled in Sydney the east coast state of New South Wales. I was put into school straight away and, because in those days I could not speak, read or write one word of English the experience at that young age was frightening because I could not communicate with anyone.
I did not want to go to school and started to take days off school. The child welfare department got sick of taking me back to school and after a few attempts; they put me before the children’s court. I was put in an institution and only because I did not attend school and I stayed there for nine months which was very painful for me as I missed my parents and sister. All the mail had to be written in English and I was able to get another boy to write a letter for me which I posted to my parents.At a young age I became a street criminal and was eventually deported from Australia back to my native Finland.
I found my way to London, England working for a living and mining my own business, not committing any crime or hurting people.
Finally to me it felt as if the roof was falling in as I am in police custody in falsified allegations of rape. No DNA, no forensic evidence, I made one statement yet someone made two other statements about me. The police profess these statement were made by me but I am saying no. I was not even in the same location when the two false and fabricated statements were made. I have never touched those two statements as the police state as the police state I was given them and read them. Forensic E.D.S.A. tests have indicated that if I made one of three statement in total I could not have made the other two. At my first trial the jury failed to agree, the judge ordered a retrial and I was sentenced to life and have now been in prison for over twenty years and am still fighting for truth and justice. I have been wrongly advised in many areas not the least of these being that one should never question the integrity of the police.

I didn’t notice it at first but I was talking less and less and seeking privacy more and more. By the time I had served several years I was a mass of inner hostility, a bubbling volcano full of bewildering emotions. I felt so crowded in, surrounded and frustrated and so distrustful of everyone that I soon found myself withdrawing more and more and building walls around myself like a fortress so deep and mighty that none could penetrate. Although I was so harshly withdrawn within myself, I always had a quick smile for anybody who addressed me kindly but at night, alone in my cell no smile would touch my face, often silent tears but no smile.
Loneliness sat heavily on my shoulders and my throbbing temples made sleep more and more difficult to attain. I could almost feel an anguished presence in the cell telling me to somehow discover a ray of hope or else I would perish too.
All sense of reality was lost in that cell where the will to go on was quickly extinguished in both the weak and the strong. If a person did not have a goal to fight off the despair and gut eating loneliness he was lost.
It is anger that will kill a man in prison, it makes him sick and angry and that’s when the system breaks him. He has to have control over his emotions and keep in touch with reality or anger will cause him to do things that are against his nature.
A person has to suffer in numerous ways before he fully knows or understands the full meaning of life. Life is not all roses and sunshine. By suffering I have certainly come to learn and understand the full meaning of life which can only be what a person wants it to be.
During my endless time in prison my dear mother first died and some years later
My dear father also died. My world fell apart. I could not attend the funeral or say a final goodbye and this had a strong affect on me.
And so it goes on………

Aika lyhyesti Hakala ohittaa Australian tapahtumat, tosin eipä hän istunutkaan kuin viisi ja puoli vuotta yhteensä (viisi vuotta Australiassa ja puoli vuotta Suomessa).

Jäin vain ihmettelemään, minne Hakalan vanhemmat on haudattu. Jos Australiaan, niin ei Hakala olisi sinne päässyt hautajaisiin osallistumaan, sillä miehellähän on elinikäinen maahantulokielto.

Peter Hakala – free at long last

I thank you all from the bottom of my heart for supporting my fight for freedom. Do not ever give in or give up fighting for all the innocent and wrongly convicted, I will always salute and honour you all in your ongoing work.

In prison there are many wrongfully convicted people. In my case a listed police informer was sent back to Australia before giving court evidence. There is no forensic evidence against me. So, yes, I am angry. I am angry because I did not manage to say goodbye and farewell to my loving parents when they died. I am angry for spending over 26 long and painful years in prison.

In October I was moved from Monster Mansions [HMP Wakefield] to Belmarsh and then handcuffed onto a flight from Gatwick – destination Helsinki, Finland, accompanied by four handpicked UKBA agents. I was handcuffed all the way, with one officer each side of me and the two others sitting side by side, and received no food or drink.

When we touched down in Helsinki my guards were surprised as there were no authorities there to meet them. Finally, a very tall young pistol-carrying airport policeman came over and wanted to know who they were and from where. My escorts gave the Finnish airport police the UKBA paper work. But the Finnish police wanted more clarification as to why a native of Finland had been flown out from England in irons, having served over 26 years in prison there, and who hadn’t done anything in Finland and wasn’t wanted there for anything.

The Finnish airport policeman finally contacted Helsinki police who have similar authority to Scotland Yard. Then he turned to the leader of my escort and ordered him to remove my handcuffs. Two Helsinki policemen then arrived and told me I was a free person and at liberty to travel wherever I wished in my native Finland. So I was finally free from the evil English system, whose representatives now left with their tails between their legs.

I was only given £26.50. I slept at Helsinki airport that night with four bags of luggage. Next day, some different policemen took me to a temporary destination from where I moved to my present location.

Inside English prisons I still have good friends who are honest and loyal; they remain very near to my heart. My friend Kevan T was bullied and intimidated at Frankland when I was there, and because I kept supporting Kevan the screws turned against me in Monster Mansion.

I want to say to the many whom I call friends, that I will contact you all in due course: Paul F, Kev T, Danny C etc. And I say to you all – be survivors and stay strong.

Peter Hakala is a Finnish citizen, arrested in Britain in 1986 and charged with rape. After a first jury could not reach a verdict, he was convicted at a second trial and sentenced to life imprisonment, with a minimum tariff of ten years. He has always protested his innocence. In October, under the terms of the ‘Tariff Expired Removal Scheme’ for foreign national prisoners, brought in as part of the Legal Aid Sentencing and Punishment of Offenders 2012, Peter was put on a plane under armed guard and dumped in Finland.

Vuosia istunut väkivaltarikollinen tuomittiin jälleen raiskauksesta
Pitkiä rangaistuksia ulkomailla istunut mies palasi Suomeen viime vuonna ja syyllistyi jälleen raiskaukseen.

Imatralainen mies on tuomittu kahdeksi vuodeksi vankeuteen raiskauksesta. Syyttäjän mukaan seksuaalirikoksista annetaan nykyisin kovempia tuomioita. Tuomio selittyy myös kovalla rikoshistorialla.

Mies on viime vuosikymmenten aikana istunut pitkiä tuomiota vankiloissa ulkomailla muun muassa raiskauksista. Vuonna 1947 syntynyt mies on Imatran raiskausta tutkineen rikoskomisarion mukaan sovittanut aikaisemmat rikoksensa.

Synkkä tausta

1970-luvun lopulla mies syyllistyi Australiassa ryöstöön ja murhaan. Hän sai tuomion, mutta hänet karkotettiin Suomeen kärsimään tuomiotaan. 1980-luvun loppupuolella mies tuomittiin vankeuteen Englannissa useasta raiskauksesta.

Mies palasi Suomeen vasta viime vuonna ja syyllistyi raiskaukseen Imatralla 14. päivä helmikuuta 2013.

Kas, Pekka Hakala palasi Suomeen, vaan ei päässyt vanhoista tavoistaan. Liekö taas piakkoin jossain vakuuttelemassa syyttömyyttään.

...vapautta ei ole koskaan kestänyt muutamaa kuukautta kauempaa.

Kyllä kuittasi Hakala nuo Australian rikoksensa kovin kevyesti, kiitos meikäläisen oikeuslaitoksen.
Samalla kun muutettiin kaikki oikeusasteet Australiassa läpikäynyt murha tapoksi, annettiin ilmeisesti anteeksi myös tuon henkirikoksen aikana päällä ollut raiskaustuomio. Hakalahan oli istumassa 12 vuoden raiskaustuomiota kun karkasi 1979, tuolla karkumatkalla sitten teki tuon ryöstömurhan.
Jos olisi täälläkin tuomittu ek, olisi tietty ollut ymmärrettävää ettei tuo raiskaustuomio olisi vaikuttanut mitään. Vaan kun rikosnimike muuttuikin täällä tapoksi, luulisi että vuosituomioon olisi sisältynyt myös jäännös tuosta raiskauksesta.
Joulukuussa -84 tänne ja kesäkuussa -85 mies olikin vapaa kuin taivaan lintu. Seuraavaksi vuodeksi sitten ehtikin britteihin raiskailemaan. Ja myöhemmin vielä tännekin.
